Description | Case Papers High Court of Justice
Linby Colliery Company (Applicants) V. James Fountayne Montague (Respondent)
Case: A mining lease was made between the two parties in 1927. The applicants claim that under a clause in the lease they were entitled to give notice to the respondent of their desire to discontinue the getting of unworked portion of coal. (this would affect the amount of royalties paid to the respondent) The respondent disagrees with this claim. (inlcudes plan, accounts and costs for coal worked and lease, 1927)
