Description | Case Papers High Court of Justice - Mr Justice Bennett, 1903-M-No. 288
Markham Main Colliery (Plantiffs) V. Earl Fitzwilliam and Others (Defendants)
Case: The plantiffs leased certain seams of coal from the defendants in 1924, which included the terms of royalty payments (See 63-B/6/45/6). When the plantiffs mine the coal they bring up the coal with other substances then sort these and pay the royalty for the tonnage of coal only brought to the surface. The defendants claim the plantiffs should be paying royalty for the tonnage of all substances they mine. (includes correspondence and photographs of screening plants at the collieries)
