DescriptionCase Papers

Foljambe (Plantiffs) V. John Smith's Tadcaster Brewery (Defendants)

Case: A piece of land called Grimethorpe Green in the Manor of Brierley was leased by William Wood for 999 years from the Plantiff's predecessor in title. William Wood sold the lease to John Smith's Brewery in 1902. The defendants tried to enfranchise the land through an a award by the Board of Agriculture under the Copyhold Act. Foljambe then issued a notice for the defendants to quit the land.
Foljambe claims a declaration that the defendants are tenants of him and that the notice to quit is valid. They also wish to have an injunction to restrain the defendants from taking further proceedings relating to purported enfranchisement. (includes copy of leases and records from Brierly Manor Court Rolls)
