Case: The Earl of Powis granted the first three defendants a mining lease in 1913. This lease was forfeited as the lessees allowed the defendants to enter into possession of some of the demised premises without the consent of the plantiff. The plantiff asserts that the defendants are trespassers and are using the premises in ways not authorised by the lease e. g. calcining, converting and disposing of limestone. The plantiff wishes to claim damages for trespassing against the defendants.
